By visiting our website or purchasing something from us, you engage in our services and agree to be bound by these Terms of Service, including any additional terms and policies referenced herein or available by hyperlink.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to sell our products.

We reserve the right to modify product descriptions, discontinue products or limit quantities where permitted by applicable law. Such changes will not affect orders that have already been accepted unless otherwise agreed with you or required by law.

5. ORDERS AND CONTRACT FORMATION

When you place an order through our website, you make an offer to purchase the selected products.

An automated order confirmation email confirms that we have received your order. It does not necessarily mean that the order has been accepted. The purchase contract is formed when we confirm acceptance of your order or dispatch the products, whichever occurs first.

We reserve the right to cancel or refuse an order for legitimate reasons, including suspected fraud, payment issues, incorrect pricing or product availability. If payment has already been taken for an order that we cancel, we will refund the amount paid.

6. PRICES AND PAYMENT

All prices are displayed in the currency indicated on our website and at checkout. Applicable taxes and delivery charges will be shown as part of the checkout process where required.

Delivery charges depend on the delivery destination and the shipment details and will be displayed before you complete your purchase.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

Payments are processed through the payment methods made available at checkout. By placing an order, you confirm that you are authorised to use the selected payment method.

7. MADE-TO-ORDER PRODUCTS AND PRODUCTION TIME

Certain MALA furniture products are made to order.

The estimated production time for made-to-order furniture is approximately 2–3 weeks. This is the production period and does not include the time required for delivery.

Production and delivery estimates are provided in good faith and may vary. If we become aware of a significant delay, we will contact you using the details provided with your order.

The fact that a product is made to order does not, by itself, mean that the statutory right of withdrawal is excluded. Any applicable exception for goods made to the consumer’s specifications or clearly personalised will apply only where permitted by law.

8. SHIPPING AND DELIVERY

We currently offer delivery through DPD to destinations served by DPD, excluding the United Kingdom and the United States. Available delivery destinations and shipping charges are displayed at checkout.

Delivery charges are calculated according to the delivery destination and shipment details, including weight where applicable.

Delivery estimates are based on the carrier’s information and are not guaranteed unless expressly stated otherwise. Furniture production time is separate from carrier delivery time.

For consumers, the risk of loss of or damage to products generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the products. Any mandatory statutory exceptions apply.

9. RETURNS, WITHDRAWAL AND REFUNDS

If you are a consumer in the European Union, you generally have the right to withdraw from an online purchase within 14 days of receiving the goods, without giving a reason, subject to statutory exceptions.

Certain goods may be excluded from the right of withdrawal where the law permits, including goods made to the consumer’s specifications or clearly personalised. A product being made to order does not automatically qualify for this exception.

If you exercise your right of withdrawal, you must notify us within the applicable period and return the goods in accordance with applicable law. Unless we have agreed otherwise or the law requires otherwise, you are responsible for the direct cost of returning the goods when you have been properly informed of that responsibility.

Where a valid withdrawal is exercised, refunds will be made within the time limits required by applicable law. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever occurs first, where permitted by law.

These provisions do not affect your statutory rights concerning faulty, damaged, misdescribed or non-conforming products.
